Visitation refers to the rights of the non-custodial parent to have scheduled time with their child or children. Child Visitation Interference
Except for in extreme circumstances, the non-custodial parent will be awarded visitation rights to maintain and nurture a relationship with their child. In some cases the court may order supervised visitation where there has been a history of neglect or a danger to the child.
A circumstance may arise where the visitation rights of the non-custodial parent are repeatedly interfered with and the child/parent relationship is undermined. In this case a court may alter the custody and visitation agreements such as providing make-up visits, an increase in visitation rights, or in extreme circumstances, a change in custody to the other parent. Again, the child's best interests are paramount and a change in custody will only be ordered under extreme circumstances.
Courts will view child support payments as a separate issue, however. Child support cannot be withheld on the basis that visitation has not been granted. You must go to court if necessary to ensure visitation rights are met.
